Tasmanian Times — Email Mailing List Terms and Conditions

These Terms and Conditions (“Terms“) govern your subscription to and use of the free email mailing list (“Mailing List“) operated by Tasmanian Times (“we“, “us“, “our“). By subscribing to the Mailing List, you agree to these Terms.

If you do not agree to these Terms, please do not subscribe.

  1. About these Terms

1.1 These Terms form a binding agreement between you and Tasmanian Times in relation to the Mailing List.

1.2 These Terms should be read together with our Privacy Policy, available at on our website, which explains how we handle your personal information.

1.3 In these Terms, “you” and “your” mean the individual who subscribes to the Mailing List.

  1. Subscribing

2.1 Subscription to the Mailing List is free of charge.

2.2 By submitting your email address and any other requested details and confirming your subscription, you consent to receiving commercial and non-commercial electronic messages from us in accordance with these Terms and the Spam Act 2003 (Cth).

2.3 You must provide an email address that you own or are authorised to use. You must not subscribe another person without their consent.

2.4 We may use a confirmation (“double opt-in”) process and may decline or cancel any subscription at our discretion.

  1. Eligibility

3.1 You should be at least 16 years of age to subscribe. If you are under 16, you may only subscribe with the consent of a parent or guardian.

3.2 By subscribing, you confirm that the information you provide is accurate and that you meet these eligibility requirements.

  1. What you will receive

4.1 By subscribing, you may receive emails including newsletters, articles, news updates, opinion and commentary, event information, appeals, and information about Tasmanian Times and its activities, as well as related promotional or commercial content.

4.2 We do not guarantee any particular frequency, schedule, or content of emails, and we may change the nature or frequency of our communications at any time.

4.3 Every commercial electronic message we send will identify us as the sender and include a functional unsubscribe facility, as required by the Spam Act 2003 (Cth).

  1. Unsubscribing

5.1 You may unsubscribe at any time by using the unsubscribe link contained in any email we send, or by contacting us at unsubscribe@tasmaniantimes.

5.2 We will action your unsubscribe request within five (5) business days, consistent with our obligations under the Spam Act 2003 (Cth).

5.3 After you unsubscribe, we may continue to send you non-promotional communications where permitted by law (for example, messages required to administer your request), and we may retain a record of your unsubscribe request to ensure we do not contact you again.

  1. Privacy and personal information

6.1 We collect, hold, use and disclose your personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles, and our Privacy Policy.

6.2 We collect your email address and any other details you provide for the purpose of operating the Mailing List, sending you communications, and related administrative and analytical purposes.

6.3 We may use third-party email and analytics service providers to deliver and manage the Mailing List. These providers may store and process your information, including potentially outside Australia. Details are set out in our Privacy Policy.

6.4 We will not sell your personal information. We will only disclose it as described in our Privacy Policy or as required or permitted by law.

7.1 You must not use the Mailing List or any content we send for any unlawful purpose or in any way that could damage, disable or impair our services.

7.2 You must not attempt to subscribe addresses you do not control, harvest addresses, or interfere with the operation of the Mailing List.

8.1 All content we send through the Mailing List, including text, images, logos and graphics, is owned by or licensed to Tasmanian Times and is protected by copyright and other intellectual property laws.

8.2 You may read and share content for personal, non-commercial purposes, but you must not reproduce, republish, distribute or commercially exploit any content without our prior written permission, except as permitted by law.

9.1 Content sent through the Mailing List is provided for general information, news and commentary purposes only. It does not constitute professional, legal, financial or other advice, and you should not rely on it as such.

9.2 Opinions and commentary expressed in our communications are those of the relevant authors and do not necessarily reflect the views of Tasmanian Times.

9.3 While we take reasonable care, we do not warrant that content is complete, accurate, current or free from error, and emails may occasionally fail to be delivered or contain technical faults.

  1. Liability

10.1 Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded.

10.2 To the maximum extent permitted by law, and subject to clause 10.1, we are not liable for any loss or damage (including indirect or consequential loss) arising from your subscription to or use of the Mailing List, the content of any email, any failure or delay in delivery, or any reliance on content we send.

10.3 To the maximum extent permitted by law, and subject to clause 10.1, our total liability to you in connection with the Mailing List is limited to re-supplying the relevant communication.

  1. Changes to the Mailing List and these Terms

11.1 We may change, suspend or discontinue the Mailing List, in whole or in part, at any time without notice.

11.2 We may update these Terms from time to time, without notice. The current version will be available on our website. Changes take effect when published, and your continued subscription after changes are published constitutes acceptance of the updated Terms.

  1. Termination

12.1 We may suspend or cancel your subscription at any time, including if you breach these Terms or if we discontinue the Mailing List.

12.2 You may end your subscription at any time by unsubscribing as described in clause 5.

  1. General

13.1 These Terms are governed by the laws of the State of Tasmania and the Commonwealth of Australia, and you submit to the non-exclusive jurisdiction of the courts of Tasmania.

13.2 If any provision of these Terms is found to be invalid or unenforceable, it will be severed and the remaining provisions will continue in full force.

13.3 Our failure to enforce any provision of these Terms is not a waiver of that provision.
