Jedi Council Sex Scandal Inquiry – given Green Light

Independent JLN Senator for Tasmania Jacqui Lambie has welcomed the news that the Australian Senate voted to approve an independent investigation into the so called “Jedi Council Sex Scandal”

“My motion to establish an independent Senate investigation by the Foreign Affairs, Defence and Trade Committee was passed on the voices without opposition. And I thank all Senators for engaging with this important matter in a non-political manner.” said Senator Lambie.

“It would have been very hard to oppose this motion after one of the victims of this so called “Jedi Council Sex Scandal – ret Lt Col Dubsky had visited parliament recently and authorised me to read into Hansard his sworn statement” said Senator Lambie.

“It would also have been very hard to oppose this investigation given that a recently uncovered, secret NSW police report (Strike Force Civet) made some damming claims about the honesty and integrity of senior ADF officers and ADFIS staff involved in the Jedi Council Sex Scandal investigation” said Senator Lambie.

“This new Senate investigation will now be able to establish the truth behind claims in the NSW police report that states: “the actions of a number of ADFIS staff and other sections of the ADF to deliberately lie, withhold evidence, fabricate information… and “the conduct of future investigations [by NSW police] into and with the ADF as [a] whole and ADFIS as a body must be viewed with caution and concern;” said Senator Lambie

“The evidence in the NSW Police report, when considered with sworn documents provided to me by ret Lt Col Dubsky – suggests that in an effort to protect Army’s public reputation, many innocent ADF members, including retired Lt Col Dubsky were the victims of deliberate and illegal media leaks from the ADF.

These illegal leaks of highly confidential ADF information breached ADF members’ right to privacy, assumptions of innocence until proven guilty – and other fundamental human rights, while causing catastrophic mental and physical harm to those ADF members and their families.” said Senator Lambie

“I’ll provide the names of people I believe should be asked to make submissions to the inquiry. They include Ret Lt Col Dubsky, who has already indicated he’d like to make a statement and answer questions about his experiences.

I’ll also ask that other people mentioned in the secret NSW police report also front the inquiry and answer questions. They include Australian of the year and former Chief of the Australian Army David Morrison, NSW Governor and former Chief of the Australian Defence force David Hurley and Ch 7 reporter Robert Ovadia.” said Senator Lambie.

“I expect all persons contacted by the committee, and offered an opportunity to make submissions, to take the opportunity. I know that many potential witnesses are keen to help the Senate get to the bottom of this very sorry chapter in defence history – which saw many courageous veterans attempt self-harm – after their lives and military careers were unfairly ruined.” said Senator Lambie.

And the website further reads: On 1 December 2016 the Senate referred the following matter to the Foreign Affairs, Defence and Trade References Committee for inquiry and report by 7 February 2017:

Can I make a submission confidentially or anonymously regarding the Jedi Council sex scandal?

“Some serving and former members of the ADF have asked me: Can I make a submission confidentially or anonymously regarding the Jedi Council sex scandal?

My office has been informed that Submissions will be assessed on a case by case basis – however there is provision for people who wish to remain anonymous or make confidential submissions to make a contribution to this important Senate Inquiry.

Submissions can be taken by the Committee and the name withheld while it is published on-line.

Submissions can also be made confidentially and / or anonymously and not be published on-line.

All people who make submissions in good faith will be protected by the rules governing any witness appearing before a Senate Committee.

Notice of Motion – Jedi Council sex scandal referred to FADT Senate Committee
Senator Lambie
Mr President,
I give notice that on the next day of sitting I shall move that:

1. The Senate notes in relation to the Jedi Council Sex scandal:

i. In a secret NSW Police report, prepared by Detective Sergeant Mark Carter, Strike Force CIVET found that “the actions of a number of ADFIS staff and other sections of the ADF to deliberately lie, withhold evidence, fabricate information… [mean] the conduct of future investigations [by NSW police] into and with the ADF as [a] whole and ADFIS as a body must be viewed with caution and concern;”
ii. The personal information of many innocent ADF members, including retired Lt Col Dubsky, was provided to the media, in breach of their right to privacy and other fundamental human rights, and without regard for their mental and physical wellbeing;
iii. The original Australian Defence Force Investigative Service (ADFIS) investigation into the alleged actions of the “Jedi Council” was limited and was conducted without direct contact with any alleged members of the “Jedi Council”;
iv. The ADFIS investigation was limited in scope and did not include appropriate follow up regarding some of the allegations;
v. The ADFIS investigation did not include interviews with alleged victims of material created or distributed by the “Jedi Council”; and
vi. A number of the conclusions reached by the ADFIS were not consistent with the evidence presented to the ADFIS as part of the investigation.

2. The matters raised by NSW Police Strike Force CIVET and other related matters be
referred to the Foreign Affairs, Defence and Trade References Committee for inquiry and report by 7th February 2017.
