… FEDERAL POLICY REDEFINING “SEX” TO INCLUDE “GENDER IDENTITY” HARMS WOMEN AND GIRLS AND VIOLATES TITLE IX LAW

ALBUQUERQUE, New Mexico – The Women’s Liberation Front (WoLF) today filed a lawsuit challenging a recent federal government policy directing educational institutions that receive federal funding under Title IX of the Civil Rights Act to interpret “sex” to include “gender identity”. Under the terms of the policy, the government defines “gender identity” as “an individual’s internal sense of gender.”

The lawsuit, which targets the United States Departments of Justice and Education, was filed on behalf of WoLF, a radical feminist organization dedicated to the liberation of women and girls from exploitation, discrimination, and sexist stereotypes. WoLF argues that defining “sex” to mean “gender identity” violates Title IX, will result in the eradication of female-only spaces in educational institutions, puts biological female students at an unfair disadvantage in athletics, and threatens the safety and privacy of women and girls. The lawsuit also contends that there is no scientific support for the concept that “gender identity” is equivalent to biological sex.

Two WoLF members, a high school and college student, are concerned that the policy will force them to share sensitive private spaces such as bathrooms, locker rooms, and changing rooms with biological males, and that this a violation of their Constitutionally-guaranteed rights to privacy.

“This policy undermines safety and bodily privacy for females by unconstitutionally eliminating Title IX protections. If anyone can use any bathroom based solely on the concept of self-declared ‘gender identity,’ that means that any male can access a women’s or girl’s room at any time, be in the presence of naked women and girls, and expose his body to women and girls. This is an outrageous assault on women’s privacy,” they said.

While WoLF supports protecting students who identify as transgender from abuse or discrimination, this policy mistakenly purports to do so by ignoring how women and girls are especially susceptible to discrimination and abuse on the basis of their biological sex, and threatens all legal protections designed to prevent and reverse sex-based discrimination. Title IX was designed to protect the rights of women and girls, and to advance the goal of achieving equality between the sexes in educational settings after centuries of exclusion of women and girls from educational institutions and inequality in funding between male and female educational programs. Defining “sex” to include “gender identity” ignores, erases, and denies this enduring reality. More generally, confusing “sex” with “gender” devalues the lived experiences of women and girls.

When a verbal, non-binding self-declaration of an “internal sense of gender” is the only qualifier for accessing female spaces, any male student at any time can legally declare himself female and have a legal right to be in female locker rooms, dressing rooms and bathrooms; male administrators, teachers and visitors do not even have to make such a declaration in order to have unrestricted access to those place. Equating “sex” with “gender identity” thus renders the legal category of biological sex meaningless and will have grave consequences for the rights of female people in the United States.

“WoLF honors and respects the civil rights of all Americans,” said WoLF spokesperson Kara Danksy. “We will continue to advance the rights and protections that the law provides for women and girls while honoring the rights and dignity of all people. The terrible consequences for women and girls is also a reflection of the fact that the federal government adopted this policy by fiat, with absolutely no public notice, discussion or debate, itself a violation of federal law.”
