CABLE CAR APPEAL – REPRESENTORS MEET TO DISCUSS OPTIONS

Residents Opposed to the Cable Car (ROCC) is inviting people who lodged a representation objecting to the cable car development on kunanyi/Mt Wellington to a meeting to discuss the potential of an appeal by the proponent, and how they can be involved.

Anyone who made a representation to the Hobart City Council’s assessment process has the right to apply to the Resource Management and Planning Appeals Tribunal (RMPAT) to become a party to the appeal, should it occur. This means they will receive all relevant information, can participate in hearings, and argue their position with regards to the points of appeal. Joined parties can also bring forward additional grounds of rejection for the consideration of the RMPAT.

“Following the comprehensive rejection of the cable car development on 21 grounds of planning and management non-compliance, the proponent has the right to appeal and has signaled its intention to exercise this right,” said Vica Bayley, spokesperson for Residents Opposed to the Cable Car.

“Equally, people opposed to the cable car who lodged a representation have the right to join the case and help to defend the decision, potentially bringing new grounds for refusal.

The window of opportunity for the proponent to lodge a legal challenge to the planning decision will likely close late next week, 14 days from when it was formally notified of the planning authority’s decision.

“ROCC intends to continue its defense of kunanyi from this cable car development by joining the appeal. We are seeking planning and legal advice on bringing new grounds for refusal, areas we believe the cable car is non-compliant but are not one of the 21 grounds of refusal.

“As part of this effort, we want to ensure others are aware of their right to participate, understand the appeal process and what’s involved in joining the proceedings.”

The meeting will be held on Monday evening (9th August) at 5.30 pm at Wild Island. Due to COVID restrictions bookings are limited in number and to those who lodged an objection.
