Draft Amendment to Battery Point and Sullivan’s Cove Planning Schemes

Posted on

Block bounded by Hampden Road, James St, Knopwood St and Montpelier Retreat

Update – 1 July 2012

• The draft amendment was certified by Hobart City Council and lodged with the Tasmanian Planning Commission then exhibited for public consultation.
• 57 representations were submitted during the public consultation period, which closed on 6 June. Hobart City Council must address the issues raised in representations in a report to the Tasmanian Planning Commission by 11 July – i.e. within 35 days – however Council may seek an extension of time from the Commission. A copy of each representation must be attached to the report.
• This report is currently being drafted and will be considered by the Development and Environmental Service Committee, then by Council. Agendas have not been set but DESC next meets on 9 July and Council on 16 July.
• Interested members of the public are encouraged to attend these meetings. Agendas and meeting papers are posted four days before the meeting at http://www.hobartcity.com.au/Council/Council_Meetings

The process

• As the draft amendment has been lodged with the Tasmanian Planning Commission, the Commission is required by law to consider it.
• Council must now consider the representations and decide whether to recommend the Commission approves, modifies or rejects the draft amendment.
• The Tasmanian Planning Commission usually holds a hearing. If you lodged a representation during the public consultation period, you are entitled to be heard by the Commission and will be contacted and asked whether you wish to attend the hearing.
• Once we know Council’s decision, there will be a community meeting to discuss next steps, including, if necessary, joint representation at the Commission.
