The answer from the DPP was “Yes”

PREMIER David Bartlett explained today why he could not appoint Richard McCreadie as temporary police commissioner. Premier David Bartlett has told State parliament this morning that he could not appoint former police commissioner Richard McCreadie as temporary police commissioner because he had been advised there was a “legal impediment”. Mr Bartlett said he had received advice from Solicitor General Leigh Sealy yesterday that precluded him from recommending the temporary appointment of Mr McCreadie, who had retired in January, as Tasmania’s police chief. Mr Sealy had earlier asked the Director of Public Prosecutions Tim Ellis, whether there were “any matters” that Mr Ellis knew about, which would make it inappropriate to appoint Mr McCreadie as temporary commissioner. “The answer from the DPP was yes,” Mr Bartlett said in Question Time this morning.
