Introductory Comments
The Tasmanian Government is currently considering an exposure draft Land Use Planning and Approvals (Tasmanian Planning Scheme) Amendment Bill 2015.
It is described by a Position Paper, which ostensibly outlines a draft of the proposed legislative model for a single Tasmanian Planning Scheme (TPS), including the foreshadowing, without adequate detail, of the amount of restriction by the State upon Local Government Planning Authorities to add their own Local Provisions.
The Position Paper is titled: ‘Reforming Tasmania’s Planning System Legislation For The Tasmanian Planning Scheme, A Position Paper For Consultation To Accompany The Draft Exposure Bill: Land Use Planning And Approvals (Tasmanian Planning Scheme) Amendment Bill 2015.’
The Paper has been prepared by the Government for consultation purposes with local government, stakeholders and the Tasmanian community on the proposed model, and accompanies the draft Exposure Land Use Planning and Approvals (Tasmanian Planning Scheme) Amendment Bill 2015.
TEA considers there has not been adequate consultation over the whole of the process and indeed we are critical of that poor quality and limited extent of consultation. It is an anathema to sound governance and in is breach of a range of standards and agreements.
TEA questions whether the Bill itself and the consultation actually meet the Tasmanian Resource Management Planning System (RMPS) objectives. Specifically in regards to the consultation aspects PART 1 – Objectives of the Resource Management and Planning System of Tasmania 1(c) “to encourage public involvement in resource management and planning;”
Why isn’t there an analysis of overall performance with the design of the planning system being described and indeed fully considered as a part of the redesign process? It is highly inadequate that no preliminary background paper setting out an overall plan has been developed.
The answer is: there is but it hasn’t been released to the public: It is the 2012 Risby Report.
